1. Agreement to Terms
By accessing or using thegardennerd.org (the “Site”) or engaging The Garden Nerd’s services, including soil feeding, garden consultations, and club membership (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the Site or Services.
2. Description of Services
The Garden Nerd provides residential soil feeding, garden consultations, and an ongoing club membership program for homeowners in Arizona. Specific service details, pricing, and scope are provided at the time of booking or membership signup and may be updated from time to time.
3. Gardening Results Disclaimer
Gardening and soil health outcomes depend on many factors outside our control, including weather, watering habits, existing soil conditions, pests, and homeowner maintenance between visits. The Garden Nerd uses proven, professional methods but does not guarantee specific plant growth, yard appearance, or timeline results. Recommendations provided during consultations are professional guidance, not a guarantee of outcome.
4. Club Membership Terms
Billing: Membership is billed on a recurring basis (monthly or annually, as selected at signup) until cancelled.
Cancellation: Members may cancel at any time by contacting us at grow@thegardennerd.org or (480) 253-9261. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for the remaining period unless required by law.
Changes to Membership: We may modify membership benefits, pricing, or terms with reasonable notice to active members.
Non-Transferable: Membership benefits apply to the registered property or account holder and are not transferable without prior written consent.
5. Scheduling and Appointments
Consultations and service visits are scheduled in advance. Please provide at least [INSERT NUMBER] hours notice for cancellations or rescheduling. Late cancellations or no-shows may be subject to a fee as disclosed at booking.
6. Payment
All fees are due as specified at booking or membership signup. We accept the payment methods listed on the Site. Prices are subject to change with notice. Changes do not affect services already paid for.

You agree to use the Site only for lawful purposes and to provide accurate information when booking services or signing up for membership. You agree not to misuse, interfere with, or attempt unauthorized access to the Site.

All content on the Site, including text, graphics, logos, and images, is the property of The Garden Nerd or its licensors and may not be copied, reproduced, or distributed without prior written permission.
9. Limitation of Liability
To the fullest extent permitted by law, The Garden Nerd is not liable for indirect, incidental, or consequential damages arising from use of the Site or Services, including but not limited to loss of plants, landscaping, or property, except where caused by our gross negligence or willful misconduct. Our total liability for any claim related to the Services is limited to the amount paid by you for the specific service giving rise to the claim.
10. Property Access and Safety
For in-person services, you agree to provide safe and reasonable access to your property. Please disclose any known hazards (pets, irrigation issues, buried lines, etc.) in advance. The Garden Nerd is not responsible for pre-existing property conditions unrelated to our work.
11. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your information.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site or Services after changes are posted constitutes acceptance of the updated Terms. The Effective Date above reflects the most recent revision.
13. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes will be resolved in the courts located in Arizona.
